Terms of Service

CineDwell prepares listing marketing packages — branded listing pages, social assets, captions, marketing copy, and seller-facing materials — from property photography and details you supply, and generates them automatically, instantly, from what you submit.

CineDwell is a marketing service. We do not provide real estate, legal, appraisal, or financial advice, and nothing we produce is a representation about a property’s value, condition, or legal status.

You must be at least 18 and able to enter a contract. You are responsible for the accuracy of your account details, for keeping your credentials secure, and for everything done under your account. Paid plans are billed monthly in advance and include a number of active listings per billing period:

• Starter — $149 per month, 6 active listings
• Growth — $399 per month, 20 active listings
• Pro — $999 per month, 60 active listings
• Branch — $2,499 per month, 250 active listings

Submitting a listing consumes one allowance from the current period. Unused allowances do not carry over. If you reach your limit, you can upgrade or wait for the next period. Prices are in US dollars and exclude any taxes that may apply.

New agents may submit one active listing and receive one free watermarked sample package. No payment card is required. Sample output is watermarked and provided for evaluation only — it is not licensed for publication or client-facing use. We may limit trials to one per agent or brokerage.

Delivery is instant. Your marketing kit and listing page generate automatically as soon as we have everything we need: the property address, at least one listing photograph, and your intended publishing platforms. Incomplete submissions or missing materials will delay availability until the required information is provided.

You keep ownership of everything you upload. By uploading, you grant CineDwell a non-exclusive, worldwide licence to host, reproduce, adapt, and process that material for the sole purpose of producing and delivering the marketing package you requested, and to host any listing page or seller presentation you choose to publish.

We will not use your photography or property details to promote CineDwell without your separate written permission.

You confirm, for everything you submit, that:

• You own it or hold the rights and licences needed to use it for marketing this listing — including any licence from the photographer.
• You have the seller's permission to market the property and to publish the details you provide.
• Publishing it will not infringe anyone's copyright, trademark, privacy, or publicity rights.
• It complies with your MLS rules, brokerage policy, and applicable advertising and fair housing law.

Photographer licences are a common issue in real estate marketing. Listing photography is frequently licensed to the agent for specific uses only, and you are responsible for confirming your licence covers the assets we produce.

Once your package is paid for and delivered, you may use the delivered assets to market that property across the channels you nominated, and to present your marketing to sellers. You may not resell the assets as a standalone product, present CineDwell’s work as another vendor’s, or reuse a package for a different property.

CineDwell retains ownership of its templates, layouts, workflows, and software. Watermarked samples remain our property until a paid package is delivered.

• Do not submit unlawful, discriminatory, deceptive, or misleading property content.
• Do not upload material you lack the rights to, or content containing malware.
• Do not attempt to access other accounts, probe our systems, or circumvent plan limits.
• Do not resell or provide access to CineDwell to third parties outside your plan's user allowance.

We may refuse, pause, or remove a submission that breaches these rules, and may suspend accounts for repeated or serious breaches.

Delivered packages include a reasonable revision round to correct errors, adjust copy, or refine emphasis. Requests that change the property, replace the photo set, or amount to a new brief consume a new listing allowance.

You can cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period, and you keep access to your allowance and delivered assets until then. We do not provide pro-rata refunds for partial months or for allowances you did not use.

If we cannot deliver a package at all, we will refund that listing or restore the allowance. Where consumer law in your jurisdiction gives you stronger refund rights, those rights apply. See our Refund Policy for the fuller version of this section.

CineDwell relies on Supabase, Stripe, Vercel, OpenAI, and Google to operate. Payments are handled by Stripe under its own terms. If you publish assets to Instagram, Facebook, TikTok, YouTube, or an MLS, that platform’s rules apply and we are not responsible for its decisions about your content.

We aim to keep CineDwell available but do not promise uninterrupted service. We may carry out maintenance, change features, or withdraw parts of the service. If we make a change that materially reduces what a paid plan includes, we will give you notice and you may cancel.

Except as expressly stated in these terms and to the fullest extent permitted by law, the service and delivered assets are provided “as is” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that our marketing will produce enquiries, showings, offers, or a sale.

To the fullest extent permitted by law, CineDwell is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost commissions, lost sales, or lost data. Our total liability for any claim relating to the service is limited to the amount you paid CineDwell in the three months before the claim arose.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or death and personal injury caused by negligence.

You agree to indemnify CineDwell against claims, damages, and reasonable costs arising from content you uploaded, from your publication of delivered assets, or from your breach of these terms — including claims by photographers, sellers, or other rights holders.

We may suspend or close an account that breaches these terms, fails to pay, or exposes us or others to legal risk. You may close your account at any time. On termination your right to use the service stops; assets already delivered and paid for remain licensed to you under section 8. Data handling after closure is covered by our Privacy Policy.

We may update these terms. If a change materially affects your rights we will notify account holders by email before it takes effect, and continuing to use CineDwell after that date means you accept the update. This version is effective 29 July 2026.

These terms are governed by the laws applicable at CineDwell’s principal place of business, and the courts there have exclusive jurisdiction, except where the mandatory law of your own country of residence gives you the right to bring proceedings locally.

These terms and the Privacy Policy are the entire agreement between us about the service. If any provision is found unenforceable, the rest continues to apply. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
